Let me know what you think of this letter.

On January 22, 2003, I received a letter (enclosure A) offering a settlement on an outstanding balance owed to Platinum Financial Services Assignee of Providian National Bank. In response to your company’s initial letter I then sent a letter (enclosure B) to Mr. Robert Burstein explaining my concerns about several incidents that I incurred while trying to reach your company via telephone. This letter also requested an original signature on an agreement to pay the settlement offer.

On February 22, 2003, I received a letter (enclosure D), offering settlement terms, but the terms stated a date in which had already passed. I did not even have time to respond to this letter when a third letter (enclosure E) arrived claiming that I had a promise to pay and your company agreed to cease all collection efforts on my account. The amount in this letter was not the same amount that was indicated in previous communication.

I am sure you are aware of all of the fraudulent companies in this world trying to collect on accounts that are not valid. When I received the initial demand letter from your office and after I called your firm, I was deeply disturbed by the communication that I had with you representatives and found myself to be very scared to communicate with your office over the telephone. As a result of this I filed a complaint with the FTC.

The letter dated, February 25, 2003 (enclosure E) stated that “As you are aware, based on your promise to pay we agreed to cease all collection efforts on your account”. My promise to pay was not valid without an original signature from a Wolpoff & Abramson representative and I did not request all collections efforts to cease. I did however request that all communication be done via the United States Postal Service.

I have enclosed a copy of an agreement to compromise this debt. This agreement will NOT be valid unless this agreement is returned to me with an original signature from a Wolpoff & Abramson representative. I have again enclosed a self-addressed stamped envelope for your convenience.
