This is a troubling issue here in sunny Florida as well. Asset Acceptance opened a new rathole orifice here a couple of years ago in Brandon, outside Tampa. The owner, Rufus "Bud" Reitzel, the "Dean of Bad Debt", lives up I-4 in Lakeland. He has big plans for debt buying according to his website. It's a good read, particularly between the lines. His Director of Legal affairs isn't a lawyer, the whole thing has a seedy fragrance about it.
They are pulling the same stunt here with SOL cases, along with a small time operator, F.A. Management Solutions out of Delray Beach, FL.
FL law sez four years on open account and this means credit cards. Five years on written contract. Apparently in addition to purchasing new dead accounts, these collection scumbags have purchased some judges just for good measure. Voila, now a credit card is five years by virtue of the 'written contract'.
What written contract you axe? Why the signed - by only one pary - application. Right, it's not exactly a contract. So the fallback BS line is "well you do owe the money and you must honor your debts."
Of course, and the CA bullies must honor debtors, some of whom they incite to suicide with their baiting calls.
Will dig into this four vs. five scam, it's just another way these bugs have stretched the statute in their favor.
Also, will be posting later in hope of hearing from court 'victims' in Florida. The judges have been acting as prosecuting attorneys for the CA's, according to some reports. See "What Now" from yesterday.
The whole thing is sickening and it is finally being noticed by some groups who may yet get involved in auditing this free-for-all in which CA's and their attorneys and the courts have apparently colluded to destroy debtors regardless of the facts.
Keep in touch. Asset Acceptance is pulling this in your state and mine because for the moment they think they can get away with it. Nothing lasts forever.
