Why Chat, I did as you suggested and my husband received a letter from Chevy Chase (First USA) stating that after researching the dispute with the CRA they were unable to clearly determine responsibility for the accout. They said that they would inform the CRAs that the account should be reported as disputed on his credit file pending a further investigation. Then they said that if he wanted to continue the dispute that he would have to fill out an affidavit of fact fraudulent credit application and submit it to their Fraud Department. What's this all about? I've disputed other items on our credit report which were beyond sol and have been succesful in getting items removed. Should he fill it out? Like I said in my previous post, I don't think he wants to get his aunt in any trouble but what can we do to get if off our report. Thanks!

Previous post:

My husband's aunt opened a Chevy Chase credit card in his name. Maxd it to the limit of $5000. It was charged off and is past SOL (Maryland). I don't even know if she used it in his name or if she just put herself down as an authorized user. We've never even seen the credit card or any bills. What happens if my husband sends a validation ltr? I don't think that he wants to get his aunt in any trouble but this item is ruining our credit report. What do you think we should or can do?

Why Chat's answer:
If it is appearing onyour husband's credit report from the OC, and you are SURE it is beyond SOL, try disputing it as "not mine, never had an account with this creditor".
If it is then verified, you can send a validation dispute letter to whomever is reporting it.
I doubt very much that the OC would have any records to be able to verify to the CRA on it if it is past SOL.
