Is he being sued in Small Claims court or is it a higher court ? In some states, lawyers are not allowed in Small Claims Court, so you'd have to check on that first before you hire a lawyer. If lawyers aren't allowed and he can't be represented w/o being there, they'll get a default judgment and then you'll be really stuck. Call the court and find out if you can go on his behalf and if so, are any forms or paperwork required by the court for you do do so.

You can try to negotiate a settlement with the atty prior to court, yes. Draw up an offer letter with YOUR terms.. the amount, how its reported to his credit report, 1099-c, payment plan, etc. and send it to the atty, CRRR. They may force court anyway but you can try.
