I paid the 5K to an actual collection agency. In turn, I received a letter simply showing that I authorized them to withdraw the 5K from my bank account. What I received from the attorney (an officer delivered it) is called "Plaintiff's Original Petition, Request for Disclosures, and Request for Admissions" It says it was filed 12/16/02 but I did not get it until 1/15/03. The back has an affidavit signed by Citibank that is attached. Do you think if I show up at court and explain my side to the judge he will agree that surely no one would plop down a lump sum of 5K unless they thought they were settling the debt? Thanks so much for your help. Oh, also, since I don't have any real property am I judgement proof?
