I think it has more to do with your state's laws, other debts you have, how you manage them and if they think you own a home or intend to in the future. If garnishment is allowed seems to factor in too. Some states are just more or less protective of debtors.

Also, if you still qualify to file bankruptcy, what motivation do they have to pursue a judgment?
