I read that you could file for a statement of exemption

Could a person have $20,000 in an IRA that was exempt from garnishment and not pay creditors owed?

If I have $20,000 in an IRA and I owe $15,000 in credit card bills - could I still keep my IRA and not pay anyone?

It seems unfair to creditors?
