Please do not serve yourself and kind friend up for sacrifice on a silver platter to these thugs. Your friend went without medical treatement for two months on account of the illegal threats against her by CA criminals. yes, the OC is liable for the CA's conduct. Has this all been placed in a medical report? LadynRed has a posting earlier this week regarding the illegalities of CA's causing aggravation to medical conditions, violations of FTC regs.
The CA and OC are painfully obvious by what they've told you. They know they have a big liability problem on their hands, so they'll play another hand at the cynics' game. In hope you'll go along, fork over some cash. They'll claim all is forgiven. They'll send a 1099 to the IRS for the - ha ha - 'forgiven' amount of the debt. So now there's a nice tax problem.
Next, as Scott points out, they'll make some more money for their poor, helpless, banker friends by selling off the 'forgiven' balance an even lower CA, who immediately will commence harassment yet again.
The OC will review CA tapes? Oh? Have they been illegally taping you? Did the CA ask permission to tape your friend during their threatening, harassing, extortionate phone calls? Did the CA state they would be taping? Did they provide a fifteen second tape tone?
How clever, they turn this around and make it your fault. They aren't worried about CA violations? Well, as long as they can coerce and trick the debtor into going along with their con game, why should they? Once you play by their rules, you've forfeited all your rights.
A good point about health risks as reason to avoid trial. So who said anything about a trial. Many times merely answering a suit with the claim that you 'lack knowledge' causes these chiggers to move to the next mark.
Their 'CONtract' won't allow a settlement lower than 50 percent? What contract? Did they produce such for you? They are free to settle if they desire.
Once you 'settle' with these gonococcal orangutangs your life will truly become interesting.
Look, Some of us have in our earlier naivete and innocence begged these rats to settle. Nyet, Nyet, Nyet, came the reply. They want two hundred eighty percent of everything for life on a generous day.
In many ways, thank goodness they didn't settle. Credit is then truly wrecked, you have IRS troubles, and new 'friends' from the CA Black Lagoon coming 'round to haunt you.
This bunch that's damaged your friend's health, peace of mind, well being is getting a sweet deal. They get some money, and in so doing all your claims of damage are relinquished. Why?
Now, back to trial and health issues. Your friend is elderly and disabled. Have you reviewed this with her doctor? A doctor's letter carries much weight with the court.
Do you think some out of town debt collector schmuck lawyer wants to stand in front of your local judge explaining his actions vis a vis an elderly diabled woman in his jurisdiction? (Voting district)?
Make sure the police know about this exploitation re no medication due to CA jail threats and, AND, taking the medication funds.
Look, even if you only put this on record, it stands in your favor. Don't document, and you've scored heavy points for the enemy.
A doctor's letter may in and of itself cause this to go away. The CA will go to its next mark. They want money for little or no effort and absolutely at minimal cost. Let them know you'll fight back and give nothing, and they'll go away.
They have no case and they know it. They are liable in several areas and they know it and hope you'll be nice and let them off the hook AND pay them.
Please understand that although these criminals do not wear masks, carry dirks, and kick down your door while you're away from home, they are what they are. They'll take anything you give them and punish you for so doing. Once they sense an easy mark, they never go away.
Smash them with every legal means. Talk to them not at all, not one second more. Put everything in writing and demand they do same. These are weaklings. At least the thief comes 'round your neighborhood, these vicious sissies hide in unmarked basement orifices.
Even a dollar to these crooks hurts you indefinetly, empowers them, sends them laughingly their favorite crack house. That's the element with whom you are dealing. Please keep that foremost in your thought while valiantly trying to protect your friend.
