Thanks Whychat. that is what I was trying to determine. Its a very interesting point in the UCC but since its for active only it deosnt really provide the consumer with the punch to force these OC's to provide the proof needed to continue to report the account.

I will try however to send a letter using similar language to what you have posted and hopefully the OC will fall for it.

Just so you know, in my cast there is no collection agency involved. yhey arent trying to collect they are content to verify with the CRA's and let it rot on my report without providing me with any info or evidence that this should be reported.
