First of all, the likelihood of a CA actually providing PROPER validation is really very slim. They can rarely do so in the manner that is required. What this means is if they can't come up with something with your signature on it, like the cc agreement PLUS a FULL accounting of the debt and the balance they claim you owe (this means ALL charges and payments for the life of the account !!), then they haven't validated and they have to cease collections and delete any tradelines on your credit report.

If they continue to harrass, unless you're beyond the SOL, you just send the next round of validation letter(s), the final one being an intent to sue letter.

As for lawsuits, if you're sued and you don't go to court the RESULT is a judgment. They have to file a lawsuit and win first before any judgment is put into place.
