The prosecutor (or District Attorney; Solicitor; whatever) would have to prove beyond a reasonable doubt that you had no intention to repay those funds when you made the charges.

This is no easy feat. Plus, you have access to lots of evidence that you were actively looking for work and expected to already have employment.

As a former prosecutor, there is no way I would be prosecuting a case like this, absent a court order pursuant to a writ of mandamus. (don't ask)

Your creditor might say that you will be going to jail, they do this sometimes. Its a violation of the FDCPA, and probably some state laws as well.

But you are not going to jail. Period.

Just get a job and start paying it back.
