Why is that ?? Because as long as the 'community' ie. the marriage, is valid, then the protection for the non-filing spouse stays in place. If your wife were to pass away (God Forbid) or you were to get divorced, dissolving the 'community', that protection would also dissolve. However once the SOL expires, community property/liability or not, no creditor could go after you anyway.
